1. Introduction to the terms and conditions

1.1 The following terms (the “Terms”) apply to any use by a visitor (the “User”) of the Glasgow Central Tours Web Site (the “Web Site”), and should be read carefully before any such use.

1.2 By accessing or using the Web Site, the User accepts and agrees to be legally bound by these Terms and acknowledges that Glasgow Central Tours, as the owner and operator of the Web Site, has the right to amend or vary these Terms and any of the contents of the Web Site from time to time at its sole discretion. If so, you will be prompted to view such additional terms and conditions on our Web Site at the time of such purchases and those terms and conditions will apply in addition to these Terms to the extent that the context permits.

2. General disclaimer

2.1 Although Glasgow Central Tours has attempted to provide accurate information on the Web Site, Glasgow Central Tours assumes no responsibility for the accuracy or completeness of such information. Except as stated elsewhere in these Terms the User releases Glasgow Central Tours, its affiliates and subsidiaries (together “Glasgow Central Tours”), and all of their officers, directors, agents and employees, from any liability, for any claims, losses or damages arising out of or in any way connected with the User’s use of the Web Site.

2.2 To the fullest extent permitted by law and except as stated elsewhere in these Terms, Glasgow Central Tours shall not be liable to any person or entity for any direct, indirect, special, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of or related to:

(a) any access to or use of or inability to access or use the Web Site, any other hyperlinked web site or any other information or product included or described within the Web Site; or

(b) any person or entity’s reliance on the information presented,

in each case whether arising in tort (including negligence), contract or otherwise even if the User has advised Glasgow Central Tours of the possibility of such damages.

2.3 All information and content provided on the Web Site is provided “as is” without representation or warranty of any kind, either expressed or implied. Without limiting the foregoing, Glasgow Central Tours does not represent or warrant that the Web Site or any of its contents are accurate, current, complete, free from technical or typographical errors, free from changes or harmful components introduced by third parties or free from periodic interruption or errors of any other type. Glasgow Central Tours may revise the information or change the products or services mentioned on the Web Site at any time without notice. Any mention of non-Glasgow Central Tours products or services is for information purposes only and constitutes neither an endorsement nor a recommendation of them. Neither Glasgow Central Tours, nor their suppliers, make any representation or gives any warranty, condition or undertaking, expressed or implied, including (without limitation) as to the satisfactory quality, fitness for a particular purpose, suitability or non-infringement of any third party right or freedom from viruses, whether or not arising from a course of dealing, usage or trade practice.

2.4 Notwithstanding any other provision in these Terms, nothing within these Terms limits or restricts any person’s liability for death or personal injury resulting from its negligence or that of its employees or agents.

2.5 These Terms and the User’s use of the Web Site are governed by all applicable Scottish law, unless the User’s address provided when purchasing a ticket or other item online is in England, when English law applies.

2.6 For any disputes arising out of or in connection with these Terms or the User’s use of the Web Site, if the User’s address provided when purchasing a ticket or other item online is in England then the English courts shall have non-exclusive jurisdiction, otherwise the Scottish courts shall have non-exclusive jurisdiction.

2.7 Glasgow Central Tours makes no representation that the content or materials on the Web Site are appropriate or available for use in other jurisdictions. Access to the Web Site’s content or its materials from jurisdictions where such access is illegal is prohibited. Users who choose to access the Web Site from other jurisdictions do so at their own initiative and risk and are responsible for compliance with all relevant local laws. Glasgow Central Tours is not responsible for any violations of law as a result of the User’s actions.

3. Trademarks and other such rights

3.1 The trademarks and logos (“Marks”) displayed on the Web Site are the property of Glasgow Central Tours or other third parties. The User is not permitted to use these Marks without the prior written consent of Glasgow Central Tours or the relevant third party proprietor of the Marks, and the User acknowledges that any such use may constitute an infringement of the relevant proprietor’s rights.

3.2 The User acknowledges that all intellectual property rights in all materials on the Web Site remain the property of Glasgow Central Tours or the relevant third party proprietor, licensor or other content owner. Except as expressly permitted herein, no portion of the information on the Web Site may be reproduced in any form, or by any means, without prior written permission from the Mark owner.

4. Links to third party web sites

4.1 The Web Site contains links to third party web sites. Access to any other web site through a link on the Web Site is at the User’s own risk and Glasgow Central Tours is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites or the security of any link or communication with those sites.

4.2 Glasgow Central Tours reserves the right to terminate a link to a third party site at any time.

4.3 The provision of a link to a third party web site through the Web Site does not mean that Glasgow Central Tours endorses, authorises or sponsors that web site nor does it mean that Glasgow Central Tours is affiliated with the third party web site’s owners or sponsors. Glasgow Central Tours provides these links merely as a convenience for the User.

5. Online ticket purchases and fees

5.1 The following terms apply if the User purchases tickets through the Web Site or in person at Glasgow Central Station.

5.2 Tour tickets are sold by Glasgow Central Tours at standard prices for the relevant tour, by requesting tickets through the Web Site, the User is placing a booking request for tickets on the Terms that is only deemed accepted by and binding on Glasgow Central Tours once valid payment has been processed and the User has been sent an email confirmation of the User’s booking.

5.3 Tour tickets are sold at the prices stated on the Web Site at the time of purchase. Users should be aware that prices for tickets may change between the date of purchase and the date of the relevant performance. Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, Glasgow Central Tours will not charge for and Users may not claim any refund of the difference.

5.4 Due to the varied and unique nature of the location the tour may not be suitable for person(s) with restricted or impaired mobility. Please contact us for further details.

5.5 The email confirmation of a booking will set out the details of the tour tickets purchased and the total amount paid, including the booking reference number (“booking reference”). Once this confirmation has been sent, the ticket price is non-refundable. The date and time of a booked and paid for ticket will not be transferable to another date and time. Glasgow Central Tours is not responsible in the event that the User selects the wrong tour when booking tickets via the Web Site, or, for reasons out with the control of Glasgow Central Tours, the User is unable to attend their confirmed tour or is excluded from attending the tour under the conditions below.

5.6 Glasgow Central Tours advises the User that e-ticketing is available for bookings, the User may use the e-ticket attached to the email confirmation of booking (“e-ticket”) on the chosen Glasgow Central Tour as their tour ticket. The User may present their e-ticket on a mobile phone or on a print out at the relevant tour start point for scanning by a Glasgow Central Tours staff member to gain entry for the User or, in the case of a group booking, the User’s group (please see clause

5.10 below for further conditions regarding group entry using one e-ticket).

5.7 If an e-ticket is used to admit a group, all members of the group, including the User, must be admitted onto the tour together and the User must be able to provide proof of ticket purchase for all members by showing the relevant e-ticket at all times during the group’s tour (including during a tour) if requested by Glasgow Central Tours staff.

5.8 Users should ensure that they arrive by the advertised performance time, as Glasgow Central Tours reserves the right to refuse admission to customers who arrive after the start of the Tour introduction.

5.9 To make any payment by credit/debit/charge card, the User must provide the cardholder’s name and email address, the card number, the card security code, the card expiry date and (where applicable) the card start date and/or issue number.

5.10 Transactions will appear on the cardholder’s bank or card statement as a payment to Glasgow Central Tours/Network Rail.

5.11 Glasgow Central Tours will endeavour to operate its tours in accordance with its advertised programme. However, there will be instances when its ability to deliver a tour is impaired by circumstances beyond its control. In such situations, Glasgow Central Tours reserves the right to cancel a tour, vary the time it starts at or provide customers with an alternative tour. If Glasgow Central Tours does have to cancel a performance, the User’s sole remedy shall be a refund of the price paid for the relevant tour tickets, and no other costs.

5.12 Glasgow Central Tours draws the User’s attention to the conditions of admittance, for tours in Glasgow Central Station and is obliged to and will refuse admission to any person who, in the opinion of an authorised Glasgow Central Tours employee or representative, is under the minimum age required for admittance. Glasgow Central Tours reserve the right to request proof of age and to exclude any such individual from any tour if they appear too young and/or cannot prove they are at least minimum age for admittance. In order for children, aged 12-15 years, to be admitted they must be accompanied by a parent or guardian who is at least 18 years of age. A maximum of three 12-15year olds accompanied by a parent or guardian is permitted. Children under the age of 12 years will not be permitted on a Glasgow Central Tour.

5.13 Use of the tickets will be subject to the terms and conditions set out in the Glasgow Central Tours Terms of Entry, which forms part of these Terms.

6. Prices, payment and VAT

6.1 Purchases made via the Web Site must be paid for using debit, credit or charge card or Glasgow Central Tours voucher (where available).

6.2 All prices displayed on the Web Site (unless otherwise stated) are inclusive of VAT (where applicable).

6.3 All transaction details, including payment card details, are encrypted using PayPal. Further, Glasgow Central Tours seeks to ensure that bank details are never transmitted in clear text through the Glasgow Central Tours booking system.

7.Web site security

7.1 The User agrees not to corrupt (or attempt to corrupt) any data or to circumvent (or attempt to circumvent) any of the security safeguards of Glasgow Central Tours or any of its suppliers.

7.2 The User acknowledges that the Internet is not entirely secure and whilst Glasgow Central Tours will take all reasonable steps to safeguard the security of any payment card information the User imparts through encryption methods, Glasgow Central Tours shall not be liable for any damage that the User may suffer as a result of the loss of confidentiality of any such information.

12. Privacy

The User acknowledges that Glasgow Central Tours is entitled to handle any personal information that the User supplies when using the Web Site in accordance with the Privacy Policy, which forms part of these Terms.

13. Miscellaneous

13.1 The failure of Glasgow Central Tours to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.

13.2 Glasgow Central Tours may assign, transfer or, where permitted by law, declare a trust over the benefit of its rights and obligations under these Terms to any party at any time without notice to the User. The User may not assign, transfer or declare a trust over his/her rights or obligations under these Terms without Glasgow Central Tours prior written consent, which may be withheld at its absolute discretion.

13.3 Glasgow Central Tours will not be in breach of these Terms or otherwise liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control.

13.4 If any part of these Terms is unenforceable, invalid or illegal (including any provision in which Glasgow Central Tours excludes its liability to the User), the enforce-ability, validity or legality of any other part of these Terms will not be affected or impaired in any way.

13.5 These Terms embody and set forth the entire agreement and understanding between Glasgow Central Tours and the User and supersede all prior oral representations (including negligent representations) or written agreements, understandings or arrangements with respect to the subject matter hereof. Neither party shall be entitled to rely on any agreement, understanding or arrangement which is not expressly set forth in these Terms. The provisions of this clause shall not exclude any liability or any right which either party may have in respect of any statements made fraudulently prior to User’s acceptance of these Terms or any fraudulent concealment by the other.

13.6 Any notice to be given by either party to the other may be sent by email or recorded delivery to the address of the other.  In the case of Glasgow Central Tours, this address shall be Glasgow Central Tours, Glasgow Central Station, Gordon St, Glasgow, G1 3SL or by email to [email protected] each as amended herein from time to time.  In the case of the User, such an address shall be that provided at the time of registration or such other address as the User may from time to time have communicated to Glasgow Central Tours in writing or by email to [email protected].  If sent by email, a notice shall be deemed to be received on the day it was sent or, if sent by recorded delivery, shall be deemed to be served two days following the date of posting.

13.7 Some of the provisions of these Terms are for the benefit of Glasgow Central Tours and its officers, directors, employees, agents, subsidiaries, affiliates, suppliers and third party information providers.  Each of these persons or entities shall have the right to assert and enforce those provisions directly against the User on its own behalf if the User violates any of these Terms.  Save for the foregoing, the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms and no rights or benefits expressly or impliedly conferred by them shall be enforceable under that Act against the parties by any other person.

Appendix ‘A’

Glasgow Central Tours Terms of Entry

1. Introduction

1.1 Glasgow Central Tours wants all of its customers to enjoy their visit to its tours. To help ensure this, admission to any Glasgow Central Tour is subject to the following terms and conditions. By purchasing or using a Glasgow Central Tours ticket, customers agree to be bound by these terms and conditions.

2. Key points

2.1 Behaviour: Glasgow Central Tours reserves the right to require customers who are disruptive, antisocial or violent to leave Glasgow Central Station immediately without any entitlement to a refund. What constitutes disruptive, antisocial or violent behaviour shall be determined at the sole discretion of the Glasgow Central Tours Tour Guide/ Duty Manager and includes both physical and verbal abuse.

2.2 Alcohol and Food Policy: Neither alcohol nor food may be brought onto the tours. Any User considered by the Tour Guide /Duty Manager to be under the influence of alcohol or drugs will be required to leave Glasgow Central Station Immediately.

2.3 Mobile Devices: All mobile devices including mobile telephones must be switched to silent at all times during the tour.

2.4 Photography will be permitted on the Tour at the discretion of the Tour Guide. Users will be informed, prior to starting the tour, of when and where photography is permitted in Glasgow Central Station. Users are required to confirm with the Tour Guide, if they are in any doubt, as to where and when they can take photographs. No video footage is permitted at any point or place within the tour or within Glasgow Central Station.

2.6 Search Policy: Glasgow Central Tours reserves the right to search a customer’s possessions whilst on the premises for any item which a staff member believes may contravene these terms and conditions. Customers must consent to being searched for any item which a staff member believes may contravene these terms and conditions. Glasgow Central Tours reserves the right to refuse entry or require a customer to leave without entitlement to a refund if consent is not given.

2.7 Parking: Glasgow Central Tours is not responsible for the parking regulations imposed by third parties, including any cost imposed on customers. Customers should take up any issues directly with the third party concerned.

2.8 Refunds: Tickets or gift vouchers purchased for a tour with Glasgow Central Tours are non-refundable. Ticket prices may change between the date of purchase and the date of the relevant performance. Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, Glasgow Central Tours will not charge for and customers may not claim any refund of the difference.

3. Entry onto a Glasgow Central Tour

3.1 Only customers in possession of a valid ticket will be admitted onto the tour to which the ticket relates and admission will be permitted only for the duration of the tour specified by the ticket. At the time of receipt or collection, customers should check that the ticket’s details are correct as tickets cannot be later exchanged or refunded in the event of any error.

3.2 Lost, stolen or damaged tickets will not be replaced. Any customer who does not hold a valid ticket may be required to leave the premises.

3.3 Customers should keep the ticket stubs or e-tickets with them at all times.

3.4 Glasgow Central Tours will refuse admission to any person who, in the opinion of an authorised Glasgow Central Tours employee or representative, is under the minimum age required for a tour and cannot prove that they are at least the minimum age required. Glasgow Central Tours expressly reserves the right to request photographic identification verifying the age of the User. Photocopies of birth certificates, (together with a form of photographic identification connecting the name on the birth certificate to the User), are acceptable. Children under the age of 12 will not be granted entry onto a Glasgow Central Tour. Children aged 12-15years of age must be accompanied by a parent or guardian. In a group a maximum of three 12-15 year old children for each parent or guardian is permitted.

3.5 Carers of disabled customers are entitled to a free ticket if the person they are accompanying can show a valid locally issued disability card. Guide and Hearing dogs are welcome but other animals are not permitted on the tour.

3.6 In order to avoid disturbing other Users, Users who arrive after the introduction to the Tour has been given, will only be permitted entry onto the tour at the Tour Guide/Duty Manager’s sole discretion.

4. Our obligations

4.1 Although Glasgow Central Tours seeks to follow its advertised programme, it reserves the right to cancel or reschedule a performance, if forced to do so by circumstances beyond its control.

4.2 If a Tour is cancelled, rescheduled or substituted, the Tour Guide/Duty Manager will have the sole discretion to decide whether to refund customers the cost of their tickets or to issue replacement tickets for a tour at an alternative time.

 

5. Safety and security

5.1 Glasgow Central Tours reserves the right to refuse the entry onto its premises of any person who is believed to be intoxicated and may require any person or customer who is believed to be intoxicated to leave the premises immediately without any entitlement to a refund.

5.2 No customer is allowed to bring any illegal substances or weapons onto the

premises. Anyone found in possession of such items will be refused entry or will be required to leave the premises immediately without any entitlement to a refund. Glasgow Central Tours takes such matters seriously and may report the incident to the police.

5.3 In order to comply with applicable health and safety legislation, customers must at all times remain within the public areas of the premises and must not obstruct the aisles with personal belongings.

5.4 Customers must keep their personal belongings with them at all times. Glasgow Central Tours accepts no responsibility for the loss, theft, alteration or damage to any personal items brought onto the premises.

5.5 Customers are not permitted to smoke on the premises of any Glasgow Central Tours this includes any form of electronic cigarette or other artificial smoking devices. Glasgow Central Tours reserves the right to require any person or customer found to be in contravention of this rule to leave the premises immediately without any entitlement to a refund.

6. Other matters

6.1 Nothing in these terms and conditions affects your statutory rights as a customer or excludes or limits Glasgow Central Tours’ liability for fraud or for death or personal injury resulting from Glasgow Central Tours’ negligence or for any other liability which Glasgow Central Tours cannot exclude or limit under law but otherwise Glasgow Central Tours’ liability to you as a customer shall be limited to the ticket price paid.

6.2 In addition to its other rights, in the event that a customer or group of customers breach or breaches any of the terms and conditions of this policy, Glasgow Central Tours reserves the right to take such action as is necessary to prevent a reoccurrence of such breach (including recovering any costs incurred). Such action may include banning the relevant customer or customers from all Glasgow Central Tours premises and/or taking legal action.

6.3 Glasgow Central Tours reserves the right to charge for any additional service or product which it may supply.

6.4 Any Glasgow Central Tours Guide/ Duty Manager may refuse entry to any person onto the premises of the relevant Glasgow Central Tour at any time and will be under no obligation to provide a reason to that person.

6.5 Glasgow Central Tours accepts no responsibility for any information displayed or broadcast on the premises by any third party.

6.6 Glasgow Central Tours reserves the right to amend these terms and conditions from time to time without notice.
